Chapter One: Introduction to Law

 

Definition of Law

 

The term “Law” has been long defined as a set of legal rules that organize the human behavior; these rules are social, general, abstract and obligatory.

This definition is general, therefore, it include all kinds of legal rules regardless of the source, whether legislations, customs, or the general rules of fairness. However, the term Law can also be defined as the formal written legal rules enacted by the competent authority in the State according to certain rules prescribed by the Constitution.

 

Objectives of Law

 

The main Objectives of Law are:

  • To organize the society by determining persons’ rights and duties.
  • To achieve justice by settling down disputes, and imposing punishments for breaking the rules of law in order to deter offenders and others.
  • To maintain public order and human welfare

 

Other terms are usually used in deferent contexts to mean law, even though each term has its own meaning in the accurate legal context.  These terms are Legislation, Statute, Act, Bill, Draft, and Code.

Main Branches of Law

Law can be divided into public and private law according to the parties involved in the relationship governed by the legal rules, the existence of the state as a sovereign person is crucial to determine whether the relation ship is governed by public or private law.

 

When the State as a sovereign person exists in a certain relation, this relation is governed by public law rules, therefore the main branches of public law are:

 

  1. Public International Law
  2. Constitutional Law
  3. Administrative Law
  4. Criminal Law
  5. Criminal Procedures Law
  6. Financial Law
  7. Environmental Law

 

However, if the state is not exist in the relationship, or exist but act as individuals or ordinary person, then the relation is to be governed by a private law rule. Therefore, the main branches of Private law are:

 

  1. Civil Law
  2. Commercial Law
  3. Labor Law
  4. Private International Law
  5. Maritime Law
  6. Family Law
  7. Civil Procedures Law

 

This classification stems from classical criteria, depending on sovereignty and authority. But it is worth mentioning that such classical classification in not decisive or final; sometimes jurists’ opinions contradict widely upon matching new branches of law with one of the main classifications, i.e. labour law, environmental law.
